Friends, do you know anything about The Child Status Protection Act (CSPA)? I just recently found out about the EB-3 visa and I’m afraid it’s too late. I really want to move to the United States and I have a daughter who is 17 years old. I’ve already read a bunch of stories from other people who have waited 4 and 5 years to get this visa, but my daughter will be 21 by then and she won’t be able to go through my visa. Is there any way to get the visa faster? I hope for your help 🙁

I understand that you only read stories about other people’s experiences, but you did not read any information about the EB-3 visa itself and CSPA for children. You should not worry because you can get this visa if you apply now. The PERM labor certification will take you about a year, and then you will file the I-140 (Immigrant Petition for Alien Workers) and at that time your daughter will definitely be under 21. The number of years of the child is fixed from the moment you file the I-140 form (CSPA age is calculated: actual age minus I-140 processing time).
